New changes to the laws relating to Trusts in Queensland

The recent legislative amendment extending the maximum duration of trusts in Queensland to 125 years marks a significant development in the state’s trust law landscape. Historically, the rule against perpetuities limited the lifespan of private trusts to 80 years, that being known as the “vesting date.”

However, as from 1 August 2025 the vesting date will be extended to 125 years, aligning Queensland with other Australian jurisdictions such as New South Wales and Victoria, which had already adopted a 125-year maximum duration.

The extension to 125 years offers settlors and beneficiaries greater flexibility in estate and succession planning. Trusts are commonly used to preserve family wealth, protect assets, and provide for future generations. The longer duration allows for more effective intergenerational wealth transfer, enabling settlors to structure trusts that can benefit descendants well into the future without the need for premature vesting or restructuring.

From a commercial perspective, the extended period enhances the utility of trusts in long-term investment and property holding structures. This is particularly relevant for family businesses, agricultural enterprises, and philanthropic foundations, which often require stability and continuity over several generations.

The ability for Queensland trusts to operate for up to 125 years represents a progressive shift, providing greater certainty and flexibility for settlors, trustees, and beneficiaries. It reflects contemporary needs for long-term asset management and succession planning, and positions Queensland as a competitive jurisdiction for the establishment and administration of trusts.
